• You agree that you shall indemnify and
defend Igage Mapping Corporation, and the corporation’s directors, officers,
and employees, against all claims, liability, damages, costs and expenses,
including reasonable legal fees and expenses arising out of or related to
1) your
breach of these Terms of Service
2)
copyrighted images for which you do not have permission to print
3) any
suit, claim, or demand arising from or relating to any text, photograph,
image, graphic, or other material you incorporated into products.
• Igage Mapping Corporation cannot, and
does not, check any submission for spelling, grammar, or any other errors.
It is the sole responsibility of the customer to ensure that all materials
submitted for printing are formatted correctly.
• Printing
errors attributed to the customer are not subject to free reprint. Errors
caused by Igage Mapping Corporation will be reprinted and shipped free of
charge by ground service.
• Igage Mapping Corporation does not
censor or refuse any material, but Igage Mapping Corporation will notify law
enforcement and provide proofs of objectionable materials to law
enforcement. Igage Mapping Corporation reserves the right to determine what
is ‘objectionable material’ and to choose the appropriate law enforcement
venue for reporting such materials. Igage Mapping Corporation will notify
customer by registered mail no sooner than 60 days after, but before 90 days
after such action is taken. Additionally, Igage Mapping Corporation will
follow any court ordered action.
• Igage Mapping Corporation accepts no
liability for materials that are subject to copyright or trademark
protections or that are otherwise in violation of the law. Igage Mapping
Corporation will not be held accountable for possession of illegal materials
or illegal use of materials. Violation of these terms of service will
indemnify Igage Mapping Corporation against any legal action.
• Igage Mapping Corporation guarantees
plotting will not be defective in accordance with industry standards. If a
plot is found to be defective, then you may contact Igage Mapping
Corporation for a reprint or a refund. Igage Mapping Corporation must be
contacted by phone at 801-412-0011 within 30 days of receiving your order.
If product is deemed defective, one of
the following resolutions at Igage Mapping Corporation’s choice will be
offered:
1) Igage
Mapping Corporation will reprint with the same production and delivery terms
extending from the time of resolution. You must return your defective plots
at your expense for us to process your reprint.
2) Igage
Mapping Corporation will authorize an RMA number for you. A Customer
Retention representative will contact you within one business day of your
initial query to help issue your RMA (Return Merchandise Authorization).
Your RMA return package must be received by Igage Mapping Corporation within
30 days after RMA is issued. Refunds will be processed only after an RMA has
been issued and the product has been returned to Igage Mapping Corporation,
after which the refund transaction will take place within five business
days.
• Igage Mapping Corporation does not
guarantee the turnaround times on any order. We attempt to ship all orders
within two business days of receipt of order.
• Igage Mapping Corporation will not
ship any plot jobs outside of the United States.
• Igage Mapping Corporation assumes no
liability whatsoever to customers for any lost business or other damages,
real or constructive. Buyer assumes full risk of possible delivery delays.
• Igage Mapping Corporation does not
refund, cancel or credit if the service failure is caused, in whole or in
part, by: Acts of God, weather conditions, environmental or dangerous goods
incidents, perils of the air, public enemies, public authorities acting with
actual or apparent authority, acts or omissions of customs officials,
authority of law, quarantine, riots, strikes, work stoppages or slowdowns,
or other labor disputes or disturbances, civil commotions or hazards
incident to a state of war, local or national disruptions in ground or air
transportation networks or systems due to events beyond our control,
disruption or failure of communication and information systems, disruption
or failure of utilities, or other circumstances beyond our control.
• Orders may only be canceled by
calling our office at +1 801 412-0011. Orders that have already printed
cannot be canceled.
•
Igage Mapping Corporation reserves the right to contact you via phone,
e-mail, or post mail regarding current and/or future orders placed with
Igage Mapping Corporation. Any customer may opt out of receiving future
contact from Igage Mapping Corporation at any time, by calling and asking to
be removed from our customer lists.
• Igage Mapping Corporation reserves
the right to share contact information with its trusted and reputable
corporate partners for the purpose of shipping and processing credit card
payments. These partners abide by their own terms of service and privacy
policy. Any further information you provide to the third party and any
dealings you have with the third party will be governed by the privacy and
other policies of that third party.
•
Color fidelity is warranted by Igage Mapping Corporation to be consistent
with industry standards for “pleasing color.” Igage Mapping Corporation
offers no guarantee of “match-print” or “match-product” color fidelity.
Igage Mapping Corporation cannot prevent slight color drift throughout an
order. Igage Mapping Corporation cannot calibrate the customers computer
monitor and therefore does not guarantee that the color printed will match
the preview as it appears on the customers monitor.
•
Igage Mapping Corporation ships its products from Salt Lake City Utah. If a
product needs to reach you by a specific date, please select a shipping
method other than ground; otherwise your product may be delayed.
